Invest Sabah Berhad (“ISB”) issued this Privacy Notice on collection and handling your personal data in accordance to the Personal Data Protection Act 2010 (“PDPA 2010”) as we hold highly of our customers and potential customers’ personal data information.
Your submission of your personal information to us signifies that you are agreed to the terms outlined in this Notice and you have given your consent for us to handle your personal data according to the procedures described herein.
Disclaimer: ISB reserves the right to review and amend this Notice accordingly. This Notice will comply with all applicable laws in Malaysia as may be amended from time to time without prior notice. However, such amendments will be placed on Invest Sabah Berhad’s website.
Types of Personal Data
a. ISB will only collect and process relevant data that is required to conduct our business matters with you. The said data is included as follows but it is not an exhaustive list:-
- i. Name, national identification number, passport number, nationality, gender, e-mail address, postal address, business address, age, phone number, employment details (past and present), bank account details, name of related relatives, skills, education background, skills, details of referees, ethnic origin, alleged commission of offences, company details (directorship, shareholder and any other related), assets, involvement in legal proceedings, past offence, insolvency, ownership of property, car registration, and any other related information that is needed for the purposes of our smooth operations.
How Are We Going to Use Your Personal Data?
a. We may use your personal data for any or all of the following purposes but the below is non-exhaustive list: –
- i. To carry out investment initiatives
- ii. To establish partnership
- iii. To adhere to legal and regulatory requirements
- iv. To ensure that other parties’ obligations towards us and/or our affiliates
- v. Responding to requests or enquiries in consonance with your telephone calls, emails and or address any complaints.
- vi. For office and operational administrative matters
- vii.For any potential illegal activities’ information given to ISB.
- viii. Making investigation on a person whose data is collected, processed and or used by us is a sanctioned person.
- ix. To disclose any party that are under obligation to make disclosures that is permitted under the laws of Malaysia.
- x. Any other matters that are related to the procedures of business.
Regardless of storage or transfer to any systems and locations within or outside Malaysia, our collection of personal data is subject to appropriate controls over information security.
Right to Provide or Not Provide Personal Data
a. Any individual has complete authority to make decisions to provide ISB their personal data or and to revoke consent given for ISB to process their personal data. If the individual does rescind their consent, ISB shall not process their personal data at all cost.
b. For any mutually agreed by both parties, your personal data is necessary for us to process. Failure to furnish the personal data, we may be unable to provide any service that deem fit upon your request
Right of Access to Your Personal Data
According to PDPA 2010, an individual is entitled to have an access to their personal data upon payment of a prescribed fee and the request to the said data access shall be done in writing, check and correct their personal data held by us.
Third Party Data Processors
Important to note that, your personal data may or may not be disclosed to any third parties within or outside ISB that are holding, collecting or even storing your personal data on our end. ISB shall not possess your personal data for their own benefit. Further, legal advisors and external auditors are included within the third parties list.
Retention of Personal Data
ISB shall take practicable steps to ensure and not retained the personal data beyond the statutory time limit. In relation to this, ISB shall comply with all relevant authorities (legal and regulatory) requirements in Malaysia.
